In a stunning victory, singer Katy Perry has emerged victorious in a trademark battle over her name against Australian designer Katie Perry. The lawsuit, brought by the designer who sells clothes under her birth name, has been overturned by three appeals judges.
The judges ruled in favor of Katy Perry, stating that she had been using her name as a trademark long before Katie Taylor entered the scene with her business. They emphasized Perry’s “international reputation” in the entertainment industry as a key factor in their decision.
Furthermore, the judges made the bold move to cancel Taylor’s trademark registration on Friday, further solidifying Perry’s win in the legal dispute.
Following the ruling, Katie Taylor expressed her disappointment, likening the legal battle to the biblical story of David and Goliath. She admitted feeling “devastated” by the outcome of the case.
The appeals judges acknowledged the unfortunate nature of the situation, recognizing that both women had worked tirelessly to build their businesses using their names as trademarks, unaware of each other’s existence.
Describing the dedication of both women, the judges stated, “Both women put blood, sweat and tears into developing their businesses.” They highlighted the fact that as one woman’s fame grew internationally, the other became aware of her namesake and filed a trademark application.
Notably, the judge who initially ruled in favor of Taylor last year referenced one of Katy Perry’s hit songs in her decision, calling it “a tale of two women, two teenage dreams, and one name.”
